Sub : Allotment of approved candidates for appointment in Relaxation of normal Recruitment Rules – Reg.

In pursuance of orders pronounced by the Hon’ble Supreme Court of India on 30.07.2010 in SLP No.2976/08 (Civil Appeal No.7773 of 2009) and 31 others pertaining to regularizing the services of candidates appointed on compassionate grounds communicated vide DDG (P)’s DO letter No. 19-5/2003-SPB-I/C dated 17.08.2010, the Chief Postmaster General, Tamilnadu Circle, Chennai 600 002 is pleased to allot the candidates mentioned in the Annexure who were approved under Relaxation of Recruitment Rules for regularisation in their respective cadres from the date of their initial engagement. The allotment of the candidates is against the available Direct Recruitment quota vacancies (5%) earmarked and kept aside for compassionate appointment for the years from 2006 to 2009 and also, as a onetime measure against the residual vacancies of Departmental quota for the years 2009 first and then if no sufficient vacancies are available in any Divisions / Units, from LGO residual vacancies of 2006, 2007 & 2008. As the residual vacancies already notified for the Exam for GDS to be held on 26.09.2010 are likely to be altered, action on this should be completed within a week and compliance be reported to Circle Office immediately.

2. Action may be taken to regularise the candidates immediately without any further delay.

3. It may also be ensured that pre-appointment formalities like verification of community certificate, educational certificates, medical fitness, undertaking, declaration, character & antecedents, etc may be carried out, if not already done. However, in view of urgency on account of court case, such formalities may be carried out subsequently but the candidates should be cautioned that their services can be terminated, if they are found ineligible for Government Service on account of such verification and their declaration to that effect may be obtained and kept on record. The community of the candidates mentioned in the Annexure is shown on the basis of information furnished by the respective Regions / Divisions / Units. Any mistakes noticed subsequently may be corrected after due verification and the corrections intimated to Circle Office also.

4. The candidate selected for appointment on compassionate grounds should be adjusted in the Roster against the appropriate category viz. UR/SC/ST/OBC depending upon the category to which he/she belongs. If there is any excess in any reserved community on account of this, the same may be adjusted against the future reserved vacancies.

5. Any request for a higher post than the one for which the candidates were approved by the Circle Relaxation Committee/Directorate, on the plea of higher qualification subsequently acquired should not be entertained.

6. Their Pay and Allowances will be fixed notionally from the date of initial engagement as in the Annexure against each candidate. These dates have been furnished as intimated by the respective Regions/ Divisions / Units. Their pay and pensionery benefits are to be protected as per the orders of the Hon’ble Supreme Court vide Judgement dated 30.07.2010. They shall not be entitled for payment of any arrears on account of such regularization.

7. Pension Rules that were in force at the time of initial engagement is applicable to them.

8. The date of joining of the applicants in their respective posts may be intimated to this office for updating the records. Charge reports should be sent to all concerned.

9. Kindly acknowledge receipt of this letter immediately.

Union Cabinet approved Direct Tax Code (DTC)

Direct Tax Code gets nod 

Paving the way for radical reform and simplification in the Direct Tax system the Union Cabinet on Thursday approved the much-talked about Direct Tax Code (DTC) Bill proposing to provide more Income Tax relief to salaried class. 

The DTC Bill, which seeks to replace the archaic Income Tax Act, 1961, proposes to raise the Income Tax exemption limit from existing Rs 1.6 lakh to Rs Two lakh, highly placed sources said. The Income Tax exemption limit for senior citizens is proposed to be raised to Rs 2.5 lakh. 

Under the moderate tax slab suggested in the DTC Bill the government proposes tax rate of 
10 per cent for income between Rs 2 lakh and Rs 5 lakh, 
20 per cent for income between Rs 5 lakh - 
Rs 10 lakh and 30 per cent for income over Rs 10 lakh.
 
Currently the Income Tax rate is 10 per cent on income above Rs 1.6 lakh and upto Rs 5 lakh, 20 per cent on income above Rs 5 lakh and upto Rs 8 lakh and 30 per cent on income above Rs 8 lakh. 

The first draft of the DTC bill had suggested 
10 per cent tax on income between Rs 1.60 lakh and Rs 10 lakh, 
20 per cent on income between Rs 10 and Rs 25 lakh and 
30 per cent beyond that


The DTC Bill proposes to levy Corporate Tax at 30 per cent and there will be no cess and surcharge on it, sources said. The DTC Bill will be introduced in the ongoing Monsoon session of Parliament. 

The Cabinet at its hour-long meeting chaired by the Prime Minister discussed at length various provisions of the DTC Bill, which will seek to bring about radical reforms and simplification in direct tax structure including the Income Tax rates and exemptions. 

The overall thrust of the DTC Bill will be on bringing about simplification of direct tax system including personal Income Tax and Corporate Tax with “an in-built bias” in favour of moderation of tax rates, sources close to the preparation of draft legislation said. 

Provisions of the DTC Bill stipulating the tax rates in direct tax front including Income tax and Corporate Tax will come into effect once it the legislation is approved by both houses of Parliament. 

The government plans to implement various provisions of the DTC Bill with effect from April One 2011

It is learnt that the government is likely to introduce the DTC Bill either tomorrow or next Monday in both houses of Parliament. After its introduction the draft DTC will be sent to Select Committee of both houses for scrutiny. 

After examining the recommendations of the Select Committee the government will move the DTC Bill for approval of Parliament in the Winter Session. 

Later, talking to newspersons, the Finance Minister Pranab Mukherjee said, “The whole objective is that a plethora of exemptions will be limited. (Income) tax slabs will be three. Rate of taxes will be taken in the schedule so that they need not be changed every year,” he said. The Finance Ministry submitted the draft DTC Bill for consideration of the Cabinet after examining responses from various stake holders including trade, industry and corporate sector.

Bi monthly meet with PMG, Trichy

Dear Comrades,
Our CS-s.r.b, Circle President-M.Balakrishnan, Circle Treasurer-Padmanabhan and Ex. CS-K. Ezhil attended bi-monthly meeting with PMG, CR on 25.08.2010. No subjects were given during the meeting. However, relocation of o/o IP, Cuddalore North and South was discussed and the PMG agreed for the relocation and issued orders. Just b4 the meeting the PMG was very much generous in issuing orders for supply of ‘data cards’ to all the IPs/ASPs in CR. (not broad band). The Association thanked the PMG during the meeting.
Before the meeting, all the new office bearers met Shri.S.P. Rajalingam, PMG, CR in PMG’s chamber as a courtesy visit and discussed with few individual cases and PMG assured to consider them favourably, early.  The PMG was given with a shawl by our C.S and the PMG has wished the new office bearers every success in all aspects.
The APMG (s) other ADs were also met by the team and had general discussions.

Bi monthly meet with PMG, Coimbatore


Dear Comrades,
Our CS-s.r.b, Circle President-M.Balakrishnan, Circle Treasurer-Padmanabhan and Ex. CS-K. Ezhil attended bi-monthly meeting with PMG, WR on 24.08.2010. The following subjects were discussed in the meeting.
New subjects:
1.       Consequent on the creation of Krishnagiri, the new postal division, the post of Dy. SPOs, Salem East Division has been diverted as SPOs of the new postal division. As such a proposal for creation of a post of ASP (OD) at Salem East Division may be considered.

Reply:  If the statistics justify, creation of ASP (OD) at Salem East Dn., will be considered.

2.       Request supply of “data card’ to all the sub divisions, since they have been supplied with ‘laptops’

Reply: Orders were received from Dte. for supply of broad band to all the sub divisions. But, instead of broad band, supply of ‘data card’ will be considered.

Pending subjects:
1.       Delay in passing of TA bills which are pending for years together in many divisions of WR.

Reply: For want of funds, the bills are pending and additional funds were asked from CO on 04.08.2010. The pending bills will be cleared, soon the funds were allotted by CO.

The PMG, WR was kind enough to issue directions to their staff, during the meeting itself for taking further necessary follow up action on the subjects placed by our Association. During the meeting itself, the PMG was given with a shawl by our C.S and the PMG has wished the new office bearers every success in all aspects.

After meeting, all the new office bearers met Shri.V.Rajarajan, PMG, WR in PMG’s chamber as a courtesy visit and discussed with few individual cases and PMG assured to consider them favourably, early.  The APMG (S) was also met by the team and discussed with few local individual problems.

One Group Meeting was organized at O/o SSPOs, Coimbatore Dn in the evening and about 10 local members participated. Some local issues were discussed.

IP Grade Pay - CHQ

Latest Position about Grade Pay to IP.

Visited Postal Directorate on 03.08.10 along with Shri.S.Ravi former CHQ Treasurer and met Director General (Posts) , DDG (Est.) and DDG(P) and had discussion on merger of posts of IP & ASP and revision of higher Grade Pay to IP. The file is with Joint Secretary & FA. The file will be put up to Postal Services Board after clearance by JS& FA.

Supplementary DPC for Group B
Supplementary DPC for promotion to PS Group B for the year 2009 has been held on 23.7.2010. Promotion cum allotment orders for around 22 IP/ASP is likely to be issued very soon.

IP/PS Group B examination result
The result of IP exam held on 03 / 05.01.10 is expected by the end of this month. After announcement of IP result, It will take another few months for release of Group B examination result.

Induction Training for Surplus qualified IPs & Direct IPs.
Lists of Surplus IP qualified candidates for the year 2008 and additional qualified candidates for the year 2007 have been released by the Directorate. Induction training for these candidates will be started during the month of October 2010.

Up-gradation of Grade Pay to the cadre of Inspector Posts

Sub: Up-gradation of Grade Pay to the cadre of Inspector Posts – regarding.

Ref: Postal Directorate No. 4-12/2009-PCC dated 22-03-2010.

Respected Madam,

This association submitted six representations requesting the Department to upgrade the Grade Pay of Inspector, Posts on par with Inspectors of CBDT/CBEC and Assistants in CSS. Last representation was submitted on 24-06-2010. The Department had detailed discussions with our association on several occasions. Department was good enough having considered our case sympathetically and submitted the file to the Ministry of Finance duly recommended but the Ministry of Finance returned the file with observation that there is post of ASP in between Inspector Posts and PS Group ‘B’ whereas no such promotional post is available in the CBDT/CBEC & CSS and hence the post of Inspector Posts is not comparable with Inspectors, Income Tax/Excise& Customs.

2. We had detailed discussions with the DDG (Estt) on 05-04-2010 and during the discussions, it was agreed to merge the post of Inspector Posts and Assistant Superintendent Posts and make it comparable with the post of Inspector CBDT/CBEC. Now, it is more than 4 months have elapsed but the proposal has not been materialized so for. It has become a burning issue in all our circle conferences and our members are very much dejected and frustrated.

3. In order to keep the post attractive, it is required to upgrade the Grade Pay of Inspector Posts on par with Inspector, CBDT/CBEC. It is further brought to your kind notice that due to implementation of MACP scheme, even the Postman has got the Grade Pay of Rs.4200/- and the Postal /Sorting Assistant has got the Grade Pay of Rs.4600/-. Now, new entrant in the cadre of Inspector Posts is getting less pay than a Postman who is being supervised by the Inspector Posts. It is not a healthy trend to have a defective command and control structure in the Department of Posts.

4. It is urged to take immediate steps to revise Grade Pay of Inspector Posts from Rs.4200/- to Rs.4600/- so that the anomaly created by the 6th CPC be removed to some extent and render justice to our cadre.

It is learnt from reliable sources that, IP Induction training to be conducted at PTC, Vadodara from 06.09.10 for 76 Candidates.

Broad Band Connection to Sub Divisions

On 09.08.2010 Directorate has allotted fund @Rs.2500/- for each Sub-Division for provision of broadband connection. Instruction has been issued by Directorate to utlise the amount by 31.08.2010. 1914 Sub-Divisions across the country will be covered under the provision.

PLI/RPLI premium can be deposited in any post office in India.

Copy of PLI Directorate no 27-02/2010-LI dated 3.8.2010.

The facility has now been provided to the PLI/RPLI customers to pay the premium anywhere in the country. They can now approach any Head Post Office or Sub Post Office to pay the premium. In the computerized Head Post Office/Sub Post Offices, if the particular policy number does not exist in the record of the HO, the system shall ask if the new policy number is to be added to the list. On choosing the option of ‘Yes’ the premium is accepted. Such policy numbers when added shall become part of the data of that post office and shall be circulated in the schedule of the month in which premium is deposited. The schedule shall be uploaded in the prescribed manner as is being done now. On uploading the schedule, the premium of such policies shall get posted in the respective KLC.

The facility to customers to pay premium anywhere shall do away the need for transfer of case file of policies from one Circle to another for the purpose of paying the premium. The case files may be transferred in accordance with existing instructions. This shall help in reducing the lapsation of policies.

Sub: – Reduction of staff under TBOP/BCR schemes stands withdrawn w.e.f 01.09.2008 consequent upon implementation of MACP.

The undersigned is directed clarify the position in respect of reduction of staff under TBOP/BCR schemes w.e.f 01.09.2008 during periodical Establishment Reviews consequent upon implementation of MACP and withdrawal of TBOP/BCR Schemes as under:

“Consequent on implementation of Time Bound One Promotion (TBOP) Scheme and Biennial Cadre Review (BCR) Scheme, Department of Posts had imposed cuts of 5% in operative staff and 15% in supervisory staff w.e.f 30.11.1983 under TBOP Scheme and later on, additional cuts of 1% in operative staff and 5% in supervisory staff were introduced w.e.f. 01.10.1991 under BCR Scheme. These cuts were introduced as measure of matching savings to offset the financial implications on account of grant of financial upgradations to staff and for obtaining additional productivity. The number of posts reduced under this matching savings/productivity provisions were kept in view at the time of periodical reviews or establishment of augmentation proposals

The said TBOP and BCR Schemes have now been withdrawn w.e.f 01.09.20087 consequent upon implementation of Modified Assured Career Progression Scheme (MACP).

Consequently, the number of operative/supervisory posts existing as on 01.09.2008 will be taken into consideration for the purpose of periodical reviews or augmentation proposals of Post Offices establishment. Thus, provisions relating to reduction of staff under TBOP/BCR Schemes stand also withdrawn w.e.f 01.09.2008.”
